By accessing or using the AI Voice Agent Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you (either as an individual or on behalf of an entity) and AI Voice Agent Platform ("Company," "we," "us," or "our").
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Account Registration and Security

To use the Service, you must:

- Provide accurate and complete registration information
- Maintain and update your account information
- Have legal authority to bind your organization (if applicable)
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your team members comply with these Terms
Organizations
When using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. The organization will be responsible for all actions taken by its members.
3. Service Description
Our Service provides an AI-powered voice agent platform that enables you to:
- Create and deploy AI voice agents for phone calls
- Build workflows using natural language or visual builders
- Integrate with third-party services (Google, HubSpot, Slack, Stripe)
- Process voice calls in real-time with low latency
- Manage organizations and team access
Service Availability: We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at our discretion.
Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
4. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit spam, unsolicited calls, or harassing content
- Engage in fraudulent or deceptive practices
- Distribute malware, viruses, or harmful code
- Attempt to gain unauthorized access to systems
- Interfere with or disrupt the Service or servers
- Scrape, copy, or reverse engineer the Service
- Impersonate others or misrepresent your identity
- Make robocalls without proper consent and compliance
- Record calls without legally required consent
- Process sensitive personal data without proper safeguards
Compliance Requirements: You are responsible for complying with all applicable regulations, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- General Data Protection Regulation (GDPR)
- California Consumer Privacy Act (CCPA)
- Payment Card Industry Data Security Standard (PCI DSS)
- Health Insurance Portability and Accountability Act (HIPAA) - if applicable
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
5. Subscription and Billing
Pricing
Pricing is available on our Pricing Page. We reserve the right to change prices with 30 days' notice to existing customers.
Billing
- Subscriptions are billed monthly in advance
- Usage-based charges (calls, minutes) are billed monthly in arrears
- Payment is processed through Stripe
- All fees are non-refundable unless required by law
- Failed payments may result in service suspension
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until that date.
Refunds
We offer a 30-day money-back guarantee for first-time subscriptions. Usage-based charges are not refundable. Contact us at billing@settermate.com for refund requests.
Taxes
Prices do not include applicable taxes. You are responsible for all taxes associated with your purchase.
6. Intellectual Property Rights
Our Rights
The Service, including all software, designs, text, graphics, interfaces, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
License to You
We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. This license terminates upon termination of your account.
Feedback
If you provide suggestions, ideas, or feedback, we may use them without any obligation to you.
7. Your Data and Content
Your Ownership
You retain all rights to your data, workflows, and content. We do not claim ownership of your information.
License to Us
You grant us a license to use, process, and store your data solely to provide the Service. This includes:
- Processing voice calls through AI models
- Storing call recordings and transcripts
- Executing workflows and integrations
- Providing analytics and reporting
Data Responsibility
You represent and warrant that:
- You have all necessary rights to the data you provide
- Your data does not violate any laws or third-party rights
- You have obtained necessary consents for data processing
- You comply with data protection regulations
Data Deletion
Upon termination, we will delete your data within 30 days, except as required by law or our backup procedures (90-day retention).
8. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted, secure, or error-free operation
- Accuracy, reliability, or quality of results
- Correction of errors or defects
AI-generated content may be inaccurate or inappropriate. You are responsible for reviewing and validating all outputs before use.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or security breaches
- Errors in AI-generated content or actions
- Third-party integrations or services
- Unauthorized access to your account
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any laws or regulations
- Your data or content
- Infringement of third-party rights
- Actions of users under your account
11. Termination
By You
You may terminate your account at any time through your account settings or by contacting us.
By Us
We may suspend or terminate your account if:
- You violate these Terms or our policies
- Your account is inactive for 12 months
- We are required to do so by law
- Continued provision creates risk or liability
- You fail to pay amounts due
Effect of Termination
Upon termination:
- Your access to the Service will cease immediately
- Outstanding fees become due immediately
- Your data will be deleted within 30 days (subject to legal requirements)
- Provisions that should survive termination will remain in effect
12. Dispute Resolution
Informal Resolution
Before filing a claim, you agree to contact us at legal@settermate.com to attempt to resolve the dispute informally.
Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.
Arbitration
